QUARRY BOARDS LIABILITY WAIVER AND RELEASE AGREEMENT

A Liability Waiver and Release Agreement ("Agreement") will need to be filled out at the shop before we can rent to you. This is required for any ("Participant") who will be on one of our boards. Participant acknowledges and agrees to the following terms:

1. ASSUMPTION OF RISK:
Participant acknowledges that engaging in paddleboarding and related water activities involves inherent risks, including but not limited to drowning, injury from falls, collisions with objects or other watercraft, weather hazards, equipment failure, and exposure to waterborne illnesses. Participant voluntarily assumes all risks associated with these activities.

2. RELEASE OF LIABILITY:
To the fullest extent permitted by law, Participant hereby releases, waives, and discharges Quarry Boards, its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, costs, or expenses arising from Participant’s rental or use of paddleboards, partyboards, and related equipment, including but not limited to personal injury, death, property damage, or loss.

3. INDEMNIFICATION:
Participant agrees to indemnify and hold harmless Quarry Boards from any claims, demands, or legal actions brought by third parties arising out of Participant’s actions while using the rented equipment.

4. SAFETY RULES AND RESPONSIBILITIES:
Participant agrees to:

  • Children under 10 years of age must wear a U.S.C.G. approved personal flotation device (PFD) at all times and be accompanied by a parent or guardian on the watercraft.

  • Children under the age of 14 must compete the Nelson Ledges Quarry Park swim test, present proof of completion, and be accompanied by a parent or guardian on the water.

  • Comply with all federal, state, and local boating laws and regulations, including those specific to Ohio and Nelson Ledges Quarry Park. Report any injuries to Quarry Board employees immediately.

  • Use equipment in a safe and responsible manner and do not drag boards to/from the water.

  • Not exceed the stipulated weight limit of 320lbs for paddleboards or 1000lbs for partyboards. 

  • Not operate the equipment while under the influence of alcohol or drugs or allow any unauthorized users on boards.

  • Do not tamper with or remove Tiles (GPS Locators/Emergency Beacons) from boards.

  • No smoking or open flames on or near boards. No sharp metal objects allowed on boards.

5. DAMAGE OR LOSS:
Participant agrees to return all rented equipment in the same condition as received, excluding normal wear and tear. Participant is responsible for any damage, loss, or theft of the equipment and agrees to pay repair or replacement costs as determined by Quarry Boards. Quarry Boards is not responsible for any lost, damaged, or stolen personal property.

6. MEDICAL CONDITION AND FITNESS TO PARTICIPATE:
Participant certifies that they are in good health, have no medical conditions that would impair their ability to safely participate in paddleboarding and are capable of swimming.

7. PHOTO AND VIDEO RELEASE:
Participant grants Quarry Boards permission to use photos or videos taken during rental activities for promotional or marketing purposes.

8. GOVERNING LAW:
Any dispute, controversy, or claim arising out of or relating to this Agreement, including its breach, termination, or validity, shall be resolved through binding arbitration in the State of Ohio except for claims that may be brought in small claims court. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA). The decision of the arbitrator(s) shall be final and binding on all parties, and judgment upon the award rendered may be entered in any court having jurisdiction. In the event that I file a lawsuit, I agree to do so solely in the state of Ohio and I further agree that the substantive law of that state shall apply.

9. ACKNOWLEDGMENT AND ACCEPTANCE:
Participant acknowledges that they have read and understood this Agreement, voluntarily agree to its terms, and waive certain legal rights, including the right to sue Quarry Boards for negligence. The Participant agrees that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
